EXEMPTION FROM SUBSECTION 602.14 (2) a) (i) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after having taken into account that this exemption is both in the public interest and is not likely to affect aviation safety, I hereby exempt JOHNNY MAY’s AIR CHARTERS (2002) Inc., P.O. Box 89, KUUJJUAK, Qc, J0M 1CO, from the requirements set out in subparagraph 602.14 (2) a) (i) of the Canadian Aviation Regulations (CARS).

This subparagraph states that no person shall operate an aeroplane over an open-air assembly of persons unless the aeroplane is operated at an altitude no less than 1,000 feet above the highest obstacle located within a horizontal distance of 2,000 feet from the aeroplane.

Purpose

The purpose of this exemption is to allow JOHNNY MAY’s AIR CHARTERS and the following flight crew member to operate an aeroplane over an open-air assembly of persons at an altitude less than 1,000 feet above the highest obstacle located within a horizontal distance of 2,000 feet from the aeroplane.

Application

This exemption applies only to JOHNNY MAY’s AIR CHARTERS and the following flight crew member when operating the Dehavilland Beaver, model DHC-2 MKI, registered C-GMAY :

Conditions

This exemption is granted subject to the following conditions:

  1. The aircraft shall be operated at altitudes and distances that are not less than those necessary for the purposes of the operation in which the aircraft is engaged;
  2. In no case shall the above altitude be less than that from which, in the event of an emergency necessitating an immediate landing, it would be possible to land the aircraft without creating a hazard to persons or property on the surface, and, in any case, at an altitude that is not lower than 200 feet above the highest obstacle;
  3. Before beginning the operation, the company shall determine one or more suitable landing areas, in the event of an emergency necessitating an immediate landing, reachable at the selected altitude with a bank not exceeding 30o;
  4. When operating over the open-air assembly of persons, the aircraft shall be flown in a straight and level flight path within a horizontal distance of not less than 300 feet at all times of the open-air assembly of persons;
  5. Except in the case of an emergency, when operating over the open-air assembly of persons all turns and/or maneuvers are prohibited;
  6. The ceiling and the visibility must be no less than 1000 feet AGL and 3 miles visibility without any precipitation;
  7. No other person, except persons essential during flight, shall be carried on board;
  8. The company shall advise and coordinate the operation with the flight service station authorities and others local authorities concerned;
  9. This exemption shall be valid for one flight, which is to be held between December 23rd, 2006 and January 2nd, 2007.

Validity

This exemption is in effect until the earliest of the following:

  1. January 2nd, 2007 at 23:59 EST;
  2. The date on which the flight has taken place;
  3. The date on which one of the conditions set out in the exemption is breached;
  4. The date on which this exemption is cancelled in writing by the Minister, where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
